Here are some important definitions to help you understand our terms and this Privacy Policy:

SparkGenius AI, Inc. and our relevant affiliates are referred to as "SparkGenius," "we," "us," and "our."

● Users are referred to as "users", "you", or "your", as applicable.

● Your use of the application (including downloading, installing, registering with, accessing, or otherwise using it) is referred to as "Use."

● To the extent, the information is: (i) associated with an identified or identifiable natural person and (ii) protected as personal data under applicable data protection laws, such information is referred to in this Privacy Policy as "Personal Data."

The privacy policy explains how we collect, use, disclose, and protect personal information if anyone decides to use our application. By using SparkTalk, you understand and agree to the collection and use of information related to this policy. The personal information we collect is used to provide and improve the services. Except as this privacy policy describes, we will not use or share your information with anyone.

This Privacy Policy does not apply to information that you provide to, or that is collected by, any third party (such as a third-party application or website), even if you access it through SparkTalk. In the event our application contains links to third-party sites and services, please be aware that those sites and services have their privacy policies. After following a link to any third-party content, you should read their posted privacy policy information about how they collect and use personal information. This Privacy Policy doesn't apply to your activities after you leave our application.

1. INFORMATION WE COLLECT AND HOW WE COLLECT IT

To provide a better experience, we may collect several types of information from you and about you, including but not limited to personal data:

● Directly from you when you provide it to us.

● When you use SparkTalk, Information collected automatically may include usage details and Internet Protocol ("IP") addresses.

● From third parties. Such as our service providers (as defined below).

2. INFORMATION YOU PROVIDE TO US DIRECTLY

We ask for and process the following information when you use the application. Such information is necessary to provide the application's complete functionality and perform the requested services.

● Information you give us. We collect information you directly give us, such as your microphone and speech recognition  permission when you engage with our app.

● Contact Information (name, e-mail address, and any other content included in the e-mail) you may fill in yourself when you contact us via e-mail. We collect, store, and process it through our cloud storage provider (Microsoft Corporaion). We use such information to respond effectively to your inquiry, fulfill your requests, send you communications that you request and perform the requested services.

3. INFORMATION THAT IS PROCESSED AUTOMATICALLY

With your permission, we use third-party automated data processing technologies (advertising or analytics tools) to analyze certain information your device sends through our application (Identity for Advertisers for iOS devices/ Advertising ID or Android ID for Android devices). Some integrated advertising or analytics tools initiate automated processing of your data, including analysis, which means any form of personal data is automatically processed for the evaluation of certain personal aspects related to you, especially the analysis or prediction of aspects related to your personal preferences, interests, behavior, location, or activities. Once you allow our application to track your activity, information processing will begin automatically through automated data processing technologies. You may withdraw your permission anytime.

We may process some information regarding your device and your user behavior based on our legitimate interests. It is typically non-personal, meaning it does not allow direct association with any specific individual, and we can only access it in aggregated form. We use this information to improve our application and provide the best experience for our users. Information that is processed automatically is as follows.

● Device Information: Information about your mobile device and an internet connection, including your IP address, unique device identifier, operating system, and mobile network information.

● Cookies and similar technologies. When you use the application, cookies and similar technologies (pixels, web beacons, scripts) may be used. Cookies are small text files containing a small amount of information downloaded to your device when you access the application. The text file is sent back to the server each time you use the application. This allows us to operate the application more efficiently. For example, we will know how many users access specific areas or features in our application and which links or ads they click on. We use this aggregated information to understand and optimize the use of our application, improve our marketing efforts, and provide content and features that interest you.

● Log file information. Log file information is automatically reported whenever you request access to the application. It can also be provided when the application is installed on your device. When you use our application, analytics tools automatically record certain log file information, including the time and date you started and stopped using the application and how you interact with it.

This automatically collected data helps us operate SparkTalk and improve it to provide better services, including but not limited to allowing us to estimate our audience size and understand how you use SparkTalk and what you like and dislike.

4. HOW WE PROCESS YOUR PERSONAL DATA

Our mission is to improve our application and provide you with new experiences continually. As part of this task, we use your information for the following purposes:

● Providing our services. We use functional and automated processed information to provide all requested services.

● Improving, testing, and monitoring the effectiveness of our application. We use automated processed information to understand user behavior and trends better, detect potential interruptions and technical issues, and operate, protect, improve, and optimize our application.

● Providing you with interest-based (behavioral) advertising or other targeted content. We may use automated processed information for marketing purposes (showing ads based on your preferences). We provide you with personalized content and information, which may include online advertising or other forms of marketing.

● Communicating with you. We use your contact information, which we must communicate with you through newsletters to send you marketing notifications, receive feedback about our application experience, and inform you of our policies and terms. When you contact us, we also use your information to respond.

● Preventing fraud and spam enforcement. We hope our application is free of spam and fraudulent content, making you feel safe and free. We may use your information to prevent, detect, and investigate fraud, security vulnerabilities, and potentially prohibited or illegal activities, protect our trademarks, and enforce our terms of use.

Suppose there are any new purposes for processing your personal data. In that case, we will let you know that we are starting to process information for that other purpose by making appropriate changes to this privacy policy.

5. SHARING OF COLLECTED INFORMATION

We do not rent or sell your personal data to any third party outside the company.

We may share your personal data, and other collected information with third-party organizations, such as contractors and service providers, who are used to support our business and are bound by confidentiality and data protection terms (consistent with this Privacy Policy) to keep your personal data confidential and use it only on our behalf ("Service Providers").

Such service providers include:

● Cloud providers; and

● Third-party analytics; and

● E-mail delivery services; and

● Third-party advertising partners. With your consent, we may send some of your personal data (such as device information and detailed information about in-app purchases) to our advertising partners (such as AppsFlyer, and Meta) for marketing and promotional purposes.

To avoid confusion, we will not share or transfer your photos, videos, and avatars to third parties. We use only secure storage places such as Amazon Web Services. Amazon Web Services, Inc. is in the United States.

What happens when changes control? Suppose we sell or otherwise transfer part or all the company or our assets to another organization (such as in a merger, divestiture, restructuring, reorganization, acquisition, bankruptcy, dissolution, liquidation, or other transaction). In that case, your personal data and other collected information may be among the items sold or transferred.

Responding to legal requests and preventing harm. Suppose we sincerely believe that the law requires us to do so. In that case, we may access, preserve, and share your information in response to legal requests (such as search warrants, court orders, or subpoenas) and government or regulatory requests. This may include responding to legal, government, or regulatory requests from jurisdictions where we sincerely believe that such response is required by law, affects users in that jurisdiction and is consistent with internationally recognized standards. We may also access, preserve, and share information when we sincerely believe it is necessary to: (i) detect, prevent, and address fraud and other illegal activity; (ii) protect ourselves, you, and others, including as part of investigations; and (iii) prevent imminent death or serious bodily harm. The information we receive about you may be accessed.

6. DATA SECURITY

The security of your personal information is very important to us. We follow widely accepted industry standards to protect the personal information submitted to us, whether in transit or after we receive it.

We take reasonable and appropriate measures to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, considering the risks and nature of the personal information involved in the processing.

We implement appropriate technical and organizational measures to effectively implement data protection principles such as data minimization and integrate necessary safeguards into the processing. We seek to encrypt your personal data using appropriate and robust encryption algorithms, including hashing algorithms, wherever possible.

Unfortunately, no internet transmission or electronic storage method is 100% secure. We try to protect your personal data but cannot guarantee its absolute security. If your personal information is breached due to a violation of security rules, we will promptly notify you in accordance with applicable law.

7. DATA RETENTION

We may retain your personal data in connection with your privacy-related requests and communications with us, if any, as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

8. EXERCISING YOUR RIGHTS

You can e-mail us at support@sparktalk.ai to request access, modification, correction, updating, deletion, or portability of any personal data we hold about you. We may not accept requests to change information if we believe that the changes violate any laws or legal requirements or cause the information to be incorrect.

European Economic Area/UK Residents. Individuals residing in the European Economic Area ("EEA") and the UK have certain legal rights regarding their personal data, including those specified under the General Data Protection Regulation (Regulation (EU) 2016/679) ("EEA GDPR") and the Data Protection, Privacy, and Electronic Communications (Amendments, etc.) (EU Exit) Regulations 2020 (SI 2020/1586) ("UK GDPR") (together referred to as "GDPR"), which may be revised from time to time. You can exercise these rights by contacting us.

● Data access and portability. You can request a copy of your personal information.

● Change or correct data. If you cannot update your data through your account, you can request the correction, change, update, or rectification of your data.

● Data retention and deletion. User data is usually retained as long as your user profile exists or providing relevant services requires it. However, specific retention periods may vary depending on the processing context. You have the right to request the deletion of all or part of your personal data.

● Processing limitation. Sometimes, you have the right to limit how your personal information is used.

California, Virginia, Colorado, Utah, and Connecticut residents may have statutory rights under their state's comprehensive privacy laws, including the following rights. You can exercise these rights by contacting us.

● The right to request the categories of personal information collected about you. SparkTalk will provide the data types we collect in legal and required circumstances.

● The right to request the categories of sources from which your personal information was collected. SparkTalk will provide the tools and organizations to collect data in legal and required circumstances.

● The right to request the purpose for which your personal information is collected for business or commercial purposes. SparkTalk will provide information on the purpose for which data is collected in legal and required circumstances.

● The right to request the categories of third parties to whom personal information is disclosed and the categories of personal information disclosed. In legal and required circumstances, SparkTalk will provide information on other organizations that may receive your personal information.

● The right to request the specific personal information collected about you. SparkTalk will provide your personal information in legal and required circumstances.

● The right to request the deletion of personal information collected about you. We may retain personal information for legal reasons but will comply with deletion requests as needed. Please note that deleting specific personal data may affect your ability to use SparkTalk.

● The right to request the correction of inaccurate personal information. If you believe your personal information needs to be corrected, you may provide personal information to replace incorrect data.

● The right to request that SparkTalk not sell or share your personal information. Each state may have a different interpretation of the term "sale" of personal information, but if you are a resident of the states mentioned above or Nevada and request that your personal information not be sold, SparkTalk will respect that request. California residents may also request that their information not be shared with any third parties.

Please note that if you make vague requests to exercise any of the above rights, we may have a conversation with you to ask for more detailed information to complete your request. If this is impossible, we reserve the right to deny your request.

Under applicable law, we may also require you to prove your identity (for example, by requesting your user or other identification) to exercise the above rights. This is done to ensure that your request does not infringe upon the rights of third parties and that the actual individual data subject or authorized person exercises the above rights.

Please note that we will process your request within one month of receiving it. Given the complexity and volume of requests, we may extend this deadline by two months if necessary. If we extend the response period, we will notify you within one month of receiving your request. We will not discriminate against you for exercising your rights under the law.

9. INTERNATIONAL DATA TRANSFERS

We work in the cross-border field and provide our application to global users. We and third-party organizations that provide automated data processing technology for the application, or our third-party advertising partners, may transfer automatically processed information from your country or jurisdiction to other countries or jurisdictions worldwide. If you are in the EU or other regions where data processing laws may differ from US laws, please note that we may transfer information, including personal information, to countries and jurisdictions with different data protection laws within your jurisdiction. This means that your personal information may be transferred to a third country, territory, or one or more specific departments within that third country or to an international organization that may provide a different level of protection than data protection and confidentiality regulations in your country. We strive to ensure that any recipients of personal data provide appropriate protection for the personal data received per existing legislation on protecting such information. By using the application, you agree that we may transfer your personal data to any third country, territory, or specific departments within that third country or international organization. For data storage, we rely on the services of hosting organizations. We highly value your privacy, so we encrypt your personal data before sending it to the hosting organization for storage. Please note that we only work with hosting organizations that have passed our security and reliability checks.

10. LINK TO ADS AND OTHER SERVICE

The Service may contain services, products, and/or links to other services, products, and websites we do not own or control. Please be aware that we are not responsible for the content or privacy practices of these other websites, products, and services. We encourage you to be aware when you access a third party's website or service and to read the privacy statements of every website and service you visit. Some of our advertisers and/or advertising partners may display ads on SparkTalk's products or services that directly solicit information or contain technology to collect information about our users. This information is collected and used by our advertisers and/or advertising partners and is outside our control. You should contact the responsible advertiser directly if you have questions about a particular advertisement.

11. CHILDREN'S PRIVACY

These services are not intended for anyone under the age of 13. We do not knowingly collect personal identification information from children under 13. If we discover that a child under 13 has provided us with personal information, we will immediately delete this information from our servers. If you are a parent or guardian and know that your child has provided us with personal information, please get in touch with us so we can take the necessary action.

12. CHANGES TO THIS PRIVACY POLICY

We may update our Privacy Policy from time to time. Therefore, we recommend checking this page periodically to review any changes. We will notify you of any changes by posting a new Privacy Policy on this page. This policy is effective as of June 29, 2023.
